Ballot Arguments/Rebuttals

California Election Code Sections 9282, 9285 and 9287 lay out the rules and parameters for ballot arguments and rebuttals, and the priority for selection of ballot arguments. Per Section 9282 (a): “For measures placed on the ballot by petition, the persons filing an initiative petition pursuant to this article may file a written argument in favor of the ordinance, and the legislative body may submit an argument against the ordinance.”

Per Section 9287: “If more than one argument for or more than one argument against any city measure is submitted to the city elections official within the time prescribed, he or she shall select one of the arguments in favor and one of the arguments against the measure for printing and distribution to the voters.” As prescribed in the Section 9287, the priority for selection of ballot arguments is: 1) the legislative body; 2) the individual voter, or bona fide association of citizens, or combination of voters and associations, who are bona fide sponsors or proponents; 3) Bona fide associations of citizens; or 4) individual voters who are eligible to vote on the measure.

Following Section 9285, the City Clerk will send a copy of the selected argument in favor to the authors of the argument against and a copy of the argument against to the authors of the argument in favor. The author or a majority of the authors of an argument may prepare and submit a rebuttal argument or may authorize, in writing, another person or persons to prepare, submit, or sign the rebuttal argument.

 

 

Opportunities to Provide Public Information/Educational Resources

While the City may not engage in activities that could be deemed advocacy, there are steps the City can take to assist the public in becoming informed about a proposed citizens’ initiative such as the FORTAG Initiative. To that end, the City will post initiative related information on the City’s website such a copy of the proposed FORTAG Initiative; City Attorney Ballot Title & Summary; 9212 Report; Ballot arguments and Rebuttals; and the City Attorney’s Impartial Analysis.
